It seems that funds donated to Amroth and District Community Association from the former Amroth Carnival may have to be returned after all. The matter has been the subject of an ongoing row, but in a press release issued to the Observer this week, it was stated: 'The committee has taken legal advice from Laura Alliss, of DJM Solicitors, who has advised that the decision taken by the four individual members, without reference to the committee as a whole, was made in breach of the terms of the constitution which governs the association. 'The advice received is that in order for the decision to be lawful, it must have been made at a special general meeting called upon the giving of 14 days' notice to all of the committee members. As the decision was made in breach of the terms of the constitution, the committee has a cause of action against the four committee members in their personal capacity for the return of the monies, however the individuals concerned have escaped such a claim due to the co-operation and understanding of the charity to which the monies were paid, which has agreed to repay the sums to the association. In accordance with the constitution, notice of a special general meeting will shortly be given to the committee members to vote to wind up the association and determine to whom the monies will be donated'.
