A Milford man who breached his restraining order twice in two days has been handed a suspended prison sentence after admitting the offences.
Thirty-one-year-old, Nathan Alan Daines of Woodbine Way, Hakin was charged with two counts of breaching a restraining order when he appeared from custody at Haverfordwest Magistrates Court on Monday to answer charges brought against him after being arrested over the weekend.
The original restraining order was made by the court on September 11.
Prosecutor, Vaughan Pritchard-Jones told the court that at 11.40 am on Friday, October 18 at Hubberston youth club, Mr. Daines’ son was playing football, when the defendant saw his wife sitting in her vehicle in the car park.
Mr. Daines then opened the doors to put bags in the car, where he started ‘begging’ to see his children.
During the early hours of the next morning, the court heard that Mr. Daines went to an address where he was not allowed to under the terms of his restraining order, shouting ‘open the door let me in’ at 2.30 am.
Police were immediately called by Mr. Daines’ wife and he was subsequently arrested.
Mr. Pritchard-Jones went on to say that the defendant accepted that he had breached his restraining order even though he gave a ‘no-comment’ interview at the Police Station.
Jonathan Webb, defending told the court that his client went to the house after having a few drinks.
He said that Mr. Daines had taken the break-up with his wife very badly and was feeling depressed because he really wanted to see his children.
Mr. Webb told the court that his client was the author of his own downfall and that if he breaches the restraining order again, he’d be going to jail.
Magistrates handed Mr. Daines an eight week prison sentence suspended for 12 months.
The defendant was also ordered to pay £85 in prosecution costs as well as a victim surcharge of £122.
